FEDERAL JUDGE BLOCKS DECISION BY TRUMP ADMINISTRATION

Newsroom/El Comercio de Colorado

Judge Richard Seeborg, from Northern California, blocked Trump administration’s policy of sending to Mexico those who are seeking asylum in the U.S. while their cases are being reviewed. This measure also applies to Mexicans, even if that is their country of origin. The Federal judge based in San Francisco, issued a preliminary order that will become effective on Friday April 12th, date after which the federal administration “won’t be able to implement or expand the program” of sending asylum seekers back to Mexico.

Also, the judge required that the 11 applicants, in whose name the lawsuit was presented, be allowed to return to the U.S. “The ruling means that nobody else can be sent to Mexico. [The Government] can’t force this policy,” said ACLU attorney Judy Rabinovitz, after the ruling was made public. ACLU, who represented the plaintiffs in the lawsuit, accused the federal government of treating immigrants in an inhumane manner, and against the law.

Attorney Melissa Crow, from the Southern Poverty Law Center (SPLC), emphasized that the ruling “will prevent highly vulnerable individuals from being trapped in very dangerous situations in Mexico.” The policy of sending asylum seekers to Mexico to wait for their cases to be solved started in January, and since then, 400 people have been sent to that country, according to numbers from the U.S Department of Homeland Security, in charge of its implementation.

Nielsen removed

The court ruling took placed one day after the resignation of Kirstjen Nielsen, Secretary of Homeland Security, who a few weeks ago had announced planes to expand the program. The judiciary system in California, with a more progressive outlook than many other courts in the country, has been chosen by activists to present lawsuits against the Trump administration, especially in the area of immigration, in which the Administration has suffered some setbacks.
