FOR LACK OF MEDICAL CARE WHILE GIVING BIRTH IN CUSTODY

Twenty-seven-year-old Diana Sánchez, presented a legal case against the government of the City of Denver, announced attorney Mari Newman. In July 2018, Sánchez was being held at a facility under the administration of the Denver Sheriff, when she gave birth to her son. The case stems from the fact that this Hispanic detainee didn’t receive any medical attention for the process of childbirth.

A surveillance video shows that Sánchez helped herself with the arrival of her son. “My defendant went to the childbirth process without medical help and in deplorable sanitary conditions,” explained Newman. The attorney said that Sánchez had warned the guards several times about her labor pains. The videos also show that the woman informed the personnel of the imminent arrival of her baby eight times.

The case explains that nurses and officers “cruelly left her alone through her labor pain for hours.” Newman said it is “incompressible” to allow a baby to be born in a cell that was dirty, hard and cold, instead of taking the mother to the hospital or to provide medical attention at the detention center. The complaint was presented after the police department ignored a previous complaint by the former prisoner.

No indemnification

With this legal case, the goal is to assert a minimum level of responsibility for an experience that could have been avoided, explained Newman. The young Hispanic woman who took care of her own childbirth was facing charges for identity theft for issuing a check from her sister’s account. Sánchez was released a few days after giving birth, with no indemnification. She is currently taking care of her two children.
